An increasing number of people are electing to get divorced without hiring an attorney. Broadly speaking, divorces without an attorney, which occur most frequently when spouses separate and believe they can agree on the terms of settlement, can be sorted into two categories: (1) divorces in which neither party has an attorney; and (2) divorces in which one spouse has an attorney, but the other spouse does not. Each of these situations presents the unrepresented party or parties with numerous potential unforeseen problems.

Some lending institutions do not give Form 1099-C enough credit. It can be an admission that indebtedness has been cancelled. For that reason, a Form 1099-C should only be filed with the IRS when a debt has been cancelled and discharged.

Can the legislature prospectively define, by statute, the meaning of an amendment to the Indiana Constitution? That’s the question when it comes to House Bill 1153—a bill being considered as a companion to House Joint Resolution 3, the proposed constitutional ban on same-sex marriage. The answer is probably not.

Andrew Diversey, a doctoral student at the University of New Mexico, challenged the university administration regarding the use of his dissertation.  When he discovered that the university had copied and made his dissertation publicly available without his permission, he demanded that all copies be returned to him.  When the university refused to comply with his request, Diversey then sued the university for copyright infringement.

NetJets is a private aviation company that offers a number of services including fractional ownership of jet aircraft, jet lease management and jet charter services.  In the 1990s, NetJets developed its own proprietary software called “IntelliJet” as an operational management tool.  NetJets began highlighting features of the IntelliJet software in its public promotions for the purpose of distinguishing its core services from the competition.  Originally the software was only used internally by NetJets employees and IT staff, but NetJets eventually expanded access to the software, allowing customers to use the tool to make flight reservations and the like.  In 1996, the company obtained a trademark registration for its INTELLIJET mark covering the goods of “computer software for managing aircraft leasing and sales.”

The Equal Employment Opportunity Commission (EEOC) has obtained record-high monetary relief in 2013 through its administrative enforcement efforts.  It is thus increasingly important for employers to be aware of the EEOC’s enforcement strategies.
