National Labor Relations Board Delays Notice Posting Rule

Regular readers of Greenebaum labor alerts will recall that, on August 30, 2011, the National Labor Relations Board (“Board”) announced a final rule (“Rule”) that will require most private employers to post a notice (“Notice”) that informs employees of their rights under federal labor law. As originally published, the Rule required covered employers to post these Notices on or before November 14, 2011. The Rule will apply to all private employers that otherwise fall within the Board’s jurisdiction, i.e., most businesses outside the aviation and railway industries who meet certain revenue thresholds.

On October 5, the Board postponed the effective date of this Rule, and granted employers until January 31, 2012 to post the Notice. Although the Board announced that it was postponing the effective date “in order to allow for enhanced education and outreach to employers . . .,” this decision came after two associations of employers filed lawsuits challenging the Board’s authority to issue the Notice.

As of now, covered employers should expect the Rule to become effective on the scheduled date of January 31, 2012, despite these pending lawsuits. Copies of the Notice can be obtained free of charge from the Board’s website at or from any Board regional office. We will keep you advised of any further developments.
