Health Care Reform: The Ruling – What now?
A sharply divided Supreme Court announced its decision to uphold most of the Affordable Care Act, including the individual mandate. The decision means that the ACA will continue to be implemented, monumentally impacting healthcare delivery and payment in the United States.
In a nutshell, the Supreme Court:
- upheld, by a 5-4 majority, the individual mandate under Congress' Taxing power;
- stated, though a different 5-4 majority, that the individual mandate is not authorized by the Commerce Clause, which Congress had cited as the constituational basis for the individual mandate; and
- held, by a 7-2 majority, that the federal government may not withold Medicaid funding from states that refuse to take part in the ACA's Medicaid expansion, a substantial limitation on Congress' Spending Clause power.
