The American Business Bankruptcy Process: Challenges and Opportunities
John W. Ames, President-Elect, American Bankruptcy Institute
Richard Boydston, Greenebaum Doll & McDonald PLLC
This program will outline and help minimize the challenges faced by companies as a creditor in a bankruptcy and point out some of the opportunities that can arise when buying assets from a debtor.
As a creditor, the business relationship may be governed by formal contracts or may simply exist on an invoice-by-invoice or order-by-order basis. The exact legal nature of the agreement may not be as clear as you think.
Debtors who have encountered serious financial trouble may have certain assets which are quite valuable. This means you should be on th elookout to obtain assets from debtors at favorable prices in bankruptcy proceedings.
