Persistence and determination on behalf of a commercial recycling client resulted in a complete victory on Sept. 4 2015, when the U.S. District Court for the Southern District of Indiana confirmed that the defendant in the complex commercial arbitration case must pay more than $3.4 million to our client.

BGD represented the client in the case that culminated in a six-day trial in January 2014.  The dispute was over the purchase and licensing of carpet recycling technology.  In a complete victory for our client, the arbitrator rescinded the contract, required the defendant to return payments to our client of $3 million, denied the defendant’s $70 million damages counterclaim, and ordered the defendant to pay the arbitrator’s $80k fee.  The defendant challenged the award on different fronts, but on Sept. 4, 2015, the U.S. District Court for the Southern District of Indiana confirmed that the defendant must pay the full amount of the award, plus interest, totaling more than $3.4 million.  The BGD litigation team was led by Phillip Fowler, Briana Clark and Victoria Cain.
