Firm Client Wins Eviction Fight


Wise Guys Bar and Grill recently prevailed in its eviction fight in Fairfield, Ohio, with a magistrate ruling in the establishment’s favor. The Dixie Highway bar that was the scene of a fatal shooting earlier this year is staying put, at least for now.

Bingham Greenebaum Doll LLP attorney Alex S. Rodger represented the bar’s operators in Fairfield Municipal Court, and said that a magistrate ruled in favor of the bar’s operators, “finding that there were no grounds for eviction.”

Magistrate Donald Moser gave no explanation for his ruling in court documents, but Rodger’s closing argument stated that proper rent payments were made for the month of June, and that renders the arguments void.

As reported by WCPO Cincinnati, the owner of the building that houses Wise Guys Bar and Grill was trying to evict the business, claiming rent hadn’t been paid and that Wise Guys wasn’t operated “in a careful, safe and proper manner.” The building’s owner cited Vincent Brown’s death in March as an example of the problems at the bar, the Journal-News reported.

Rodger explained that the building owner is one of the largest owners of car dealerships in southwest Ohio and was seeking to evict the tenants in hopes of demolishing the building and expanding an existing dealership.
