Kentucky Division of Water Proposes Two KPDES General Permits
On April 1, 2014, the Kentucky Division of Water (DOW) issued a Draft General Permit for facilities engaged in the manufacture and delivery of concrete products, asphalt paving mixtures, or Portland cement concrete in a plastic and unhardened state. DOW also issued a Draft General Permit for facilities engaged in the extraction of non-coal mineral resources and the onsite processing of those minerals. The comment period for both permits closed on May 16, 2014.
General Permit KYG110000 will be the first issuance of a General KPDES Permit to address permanent and portable Pre-Cast Plants, Hot Mix Plants, Ready-Mix Plants, and associated activities. The Draft General Permit covers both process and non-process wastewaters.
Draft General Permit KYG840000 is a reissuance of the General KPDES Permit for non-coal (mineral) mining and associated activities, including: mining of limestone and dolomite; mining of sand and gravel; dredging of river or creek sand and gravel; mining of clay; mining of rock asphalt; and mining of fluorspar and other vein minerals. Onsite processing activities for this Draft General Permit include: classifying, crushing, sizing, and washing of mined minerals; Plant Mix Asphalt plants; and Concrete Ready Mix plants. With certain exclusions, mineral mining operations that have obtained a Surface Disturbance Mining Permit from the Division of Mine Reclamation and Enforcement or those facilities in the process of obtaining such a permit, are eligible for coverage under this General Permit. Plant Mix Asphalt plants and Concrete Ready Mix plants within an approved permit area and operated by the mineral mining permit holder do not require separate KPDES Permits. The previous permit, which expired on June 30, 2012, broke down effluent limitations and monitoring requirements into four categories. However, this permit divides effluent limitations and monitoring requirements into two categories: controlled and non-controlled mine dewatering; and process wastewaters.
