Peter Tschanz featured in The Indiana Lawyer
Recently, BGD Associate, Peter Tschanz was featured in The Indiana Lawyer article, “In labor arbitration class action, 7th Circuit asks, ‘What happens next?” The article addressed a recent Seventh Circuit decision regarding arbitration agreements that include a waiver of an employee’s right to join others in class/collective arbitration.
While weighing in on the decision, Pete stressed the importance of drafting an agreement that contains a clear an unmistakable waiver of this right. Pete also noted that the decision gives the district court the responsibility of determining whether the plain language of the waiver is valid. This is significant because it would be extraordinarily difficult to challenge an arbitrator’s interpretation of the waiver since judicial review in this context is very limited.
