Proposed amendments purporting to revise definitions to reflect the federal New Source Review program.  Amendments include requirements necessary to determine whether a construction project’s emissions will cause or contribute to a violation of the PM2.5 NAAQS. Reviewed without attachment at the October 9, 2012 ARRS meeting.  Amendments became effective on December 7, 2012

Proposed amendments to 5:055 purport to update citations to corresponding federal regulations and clarify that state requirements relating to approval of innovative technology are the same as federal requirements. Amendments to 5:060 purport to update citations to corresponding federal regulations and clarify that state requirements are the same as the federal requirements. Additionally, the amendment clarifies the cabinet’s authority for continuation of an expired permit. Statement of consideration responding to public comments and proposed amendments “as amended after comments” filed October 5, 2012. Reviewed without attachment at the January 7, 2013 ARRS meeting. Scheduled to be referred to the Joint Committee on NRE on February 6, 2013.

Proposed amendments resulting from triennial review of water quality standards. Statement of consideration responding to public comments as well as proposed changes to 10:031 as “amended after comments” filed November 15, 2012. Pursuant to agency request, ARRS review was deferred in December and January.  Currently the proposed amendments are tentatively on the agenda for the February 11, 2013 ARRS meeting.
