Peter concentrates his practice in the areas of health care and insurance law, including state and federal regulatory compliance, certificate of need, licensure, fraud and abuse, and litigation. He also advises clients on issues involving state procurement law and employee benefits.

Career Highlights

Representative Cases and Achievements

  • Advised various types of health care providers, including physician practices, acute care hospitals, ambulatory care centers, ambulatory surgical centers, comprehensive physical rehabilitation hospitals, home health agencies, megavoltage radiation service providers, psychiatric residential treatment facilities and special health clinics, on Kentucky certificate of need and licensure issues 
  • Represented health care providers in various administrative proceedings on certificate of need applications and before the Kentucky Boards of Dentistry and Pharmacy 
  • Drafted legal memoranda regarding, and advised various types of health care providers on, fraud and abuse, Stark law, Medicare/Medicaid reimbursement and HIPAA issues, as well as other federal and state regulatory issues 
  • Developed compliance plans for health care providers 
  • Advised physician practices on general corporate law issues 
  • Negotiated and drafted various types of agreements for health care providers, including employment agreements, recruitment agreements, medical director agreements, lease agreements and operating agreements 
  • Negotiated and drafted transactional documents for and conducted due diligence review in connection with the acquisition and sale of physician practices and sponsors of Medicare Advantage and Part D plans 
  • Member of the firm’s Health Care Reform Task Force and wrote and presented speeches on delivery and payment system reforms, elder care issues, and medical loss ratios under federal health care reform  
  • Represented health insurance company in procurement litigation involving the award of a contract to serve as the third party administrator for the state employees health plan 
  • Represented clients in numerous actions concerning provider agreements in both civil actions and arbitrations, including arbitrations under the Federal Arbitration Act 
  • Advised clients on the application of Any Willing Provider laws to provider agreements and preemption of those laws in certain situations 
  • Advised clients on, and represented clients in litigation involving, preemption of state law under the Medicare Modernization Act, ERISA, FEHBA and TRICARE 
  • Advised clients on, and represented clients in litigation involving, the interpretation and application of the Medicare Advantage and Part D Programs rules and regulations, including the Medicare Marketing Guidelines and provider participation requirements 
  • Advised health insurance company on numerous state and federal regulatory issues, including agent relations, network management and operations, and non-health insurance products, and drafted responses to agency inquiries and complaints 
  • Advised clients, including agents, brokers, insureds and insurers, on general insurance law issues 
  • Advised employers on the establishment and operation of on-site medical clinics for their employees 
  • Advised clients on Kentucky Model Procurement Code and federal procurement issues 
  • Advised clients on issues involving health savings accounts, wellness programs and cafeteria plans
