Zoning and Land Use

Zoning and Land Use

Over the years, Bingham Greenebaum Doll’s team of real estate professionals, which includes attorneys and land planners, has developed an in-depth knowledge of all aspects of land use law, including planning, zoning and subdivision law. We’ve created strong relationships with community and industry leaders, and have leveraged these relationships for the benefit of communities across the Midwest.

Utilizing this experience, we serve as counsel to developers and builders throughout the Midwest on commercial, industrial and residential projects, as well as projects related to both conventional and renewable energy production. We work with large and small clients to save them time and money and to help them prosper in this highly competitive market.

On the administrative and municipal level, we regularly prepare, file and secure approvals for zone changes, variances, conditional use permits, and historic preservation approvals. The zoning approval process can require mediating differences with organized opposition, conducting mandatory public hearings and, when necessary, litigation.

We draft proposed regulations, statutes and comprehensive plan provisions and successfully process other zoning-related work. We also are experienced in the court systems of Indiana, Kentucky and Ohio, successfully resolving zoning-related litigation in circuit courts, Courts of Appeal, and Supreme Courts.

We assist clients with legal services that include:

  • Zoning and permit assistance
  • Municipal land use planning
  • Representation before public boards
  • Utility planning
  • Drafting/revising municipal zoning codes
  • Annexation
