Collective and Class Action


Bingham Greenebaum Doll LLP's attorneys work closely with their clients to find solutions to meet each client's needs. We assist our employer clients with collective actions, which concern class type litigation under the Federal Fair Labor Standards Act on a variety of issues including, but not limited to, claims in which employees challenge their exempt classifications (from overtime pay) on a class-wide basis. These collective actions typically concern potentially hundreds of employees in the collective group.

We also assist our employer clients with class actions, which may involve federal and state employment discrimination claims in which our corporate clients are being sued for employment decisions by a class of similarly situated employees with common employment claims.

Our team develops strategies for our attorneys and in-house client counsel to implement to defend against such actions including, but not limited to, endeavors to persuade courts to deny employees' motions to certify classes and to send notices of conditional class certifications to our clients' employees.
