Economic Development, Site Selection and Incentives

The location and creation of a new facility, or the expansion of an existing plant, are extremely important events for a business and the surrounding area. The Bingham Greenebaum Doll LLP Economic Development Practice Group works with both private companies and governmental entities through the entire process of developing, redeveloping, creating or expanding a business and/or property.

Our attorneys have extensive experience in each of the necessary roles, including:

  • Site selection
  • Land and equipment acquisition
  • Construction and design contracts
  • Environmental permitting
  • Licensing
  • Tax planning
  • Creation of business processes and procedures for the smooth commencement of operations

Our credentials and experience, together with the diverse talent and resources of the firm, allow us to serve our business and governmental clients both efficiently and effectively. In order to provide our clients with the best possible outcome, we regularly collaborate with attorneys from other practice areas within the firm, including:

  • Government
  • Real Estate
  • Tax & Finance
  • Environmental
  • Energy
  • And others

The Group maintains a network of state and local economic development contacts, combined with our own local knowledge, to readily identify potential site candidates. Our economic development attorneys actively identify, evaluate, and recommend selected sites meeting the selection criteria of the client.   Our practice group members evaluate each site based on:

  • Local zoning
  • Workforce
  • Community acceptance
  • Site conditions (including access and utility service)
  • Local property tax rates
  • Impact fees
  • Other costs and benefits

Our goal is not just to provide options, but to provide meaningful distinctions between good sites and great sites, so your objectives will be met.  With professionals in Indiana, Kentucky and Ohio we are positioned to identify the best alternatives for a project, while helping to establish the competitive framework within which to best position incentive procurement negotiations.

The Group has developed a substantial practice in the acquisition, negotiation and documentation of economic development incentives for corporate clients locating or expanding their businesses. These incentives include:

  • Direct impact fee grants
  • Real property contributions
  • Tax credits
  • Government road funding
  • Low interest loans
  • Infrastructure financing
  • Equipment financing
  • Training grants and workforce development programs

Team members also serve as counsel to companies and organizations in obtaining, negotiating and documenting industrial revenue bonds and other tax abatement tools.

Our Economic Development Practice Group has experience negotiating competitive offerings in Indiana, Kentucky, Ohio and other states, and in working with various state and local agencies, development districts and other governmental units.  In instances where the available incentives are insufficient for our clients, we have worked with governmental entities to develop legislation and creative programs to provide a more attractive investment environment.
